Privacy Policy

SIA “SALONCONCEPT BALTIC” undertakes to ensure the protection and privacy of your personal data in accordance with:
 
Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC (General Data Protection Regulation);
 
other laws and regulations in force in the Republic of Latvia in the field of personal data processing and privacy;
 
and this Privacy Policy.
 
By means of this Privacy Policy SIA “SALONCONCEPT BALTIC” provides you with information about the principles, methods, purposes, scope, conditions and time limits of the personal data processing it carries out, as well as about your rights in relation to our processing of personal data.


1. Definitions
 
1.1. Personal data – any information relating to an identified or identifiable natural person.
 
1.2. Data subject – an identified or identifiable natural person (hereinafter – the client).
 
1.3. Profiling – automated processing of personal data consisting of the use of personal data to evaluate certain personal aspects relating to a natural person.
 
1.4. Controller – SIA “SALONCONCEPT BALTIC” (hereinafter also – SALONCONCEPT BALTIC).
 
1.5. Processor – a natural or legal person which processes personal data on behalf of the controller SALONCONCEPT BALTIC.
 
1.6. Third party – a natural or legal person, public authority, agency or body which is not the data subject, controller or processor, and persons who are authorised to process personal data under the direct authority of the controller or processor.
 
1.7. Consent of the data subject (client) – a freely given, specific, informed and unambiguous indication of the client’s wishes, by a statement or by a clear affirmative action, signifying that the client agrees to the processing of his or her personal data.
 
1.8. Cookies – text files that are stored on the device used by the user in order to individualise the use of the SALONCONCEPT BALTIC website for each particular website user.


2. Controller and processor of personal data
 
2.1. The controller of personal data is SIA “SALONCONCEPT BALTIC”, reg. No. 40203187230, registered office: Krišjāņa Barona iela 64-4, Rīga, LV-1011.
 
2.2. The processors of personal data are legal persons who process personal data on behalf of SALONCONCEPT BALTIC and in accordance with the instructions of SALONCONCEPT BALTIC, and who have undertaken to comply with the requirements of laws and regulations in the field of data processing.


3. Categories and types of personal data of clients under processing
 
3.1. The categories of personal data of clients processed by SALONCONCEPT BALTIC differ depending on which services of SALONCONCEPT BALTIC the client wishes to use.
 
3.2. The categories of personal data of clients processed by SALONCONCEPT BALTIC are divided as follows:
 
3.2.1. processing of the client’s personal data for the issuance of SALONCONCEPT BALTIC client cards and other activities related thereto;
 
3.2.2. processing of the client’s personal data for registration in the SALONCONCEPT BALTIC e-store and other activities related thereto;
 
3.2.3. processing of the client’s personal data for sending SALONCONCEPT BALTIC news by e-mail, in SMS form or by post;
 
3.2.4. processing of the client’s personal data for security purposes;
 
3.2.5. processing of the client’s personal data for other marketing purposes (publicity events).
 
3.3. For the purpose of providing client cards and related marketing offers, SALONCONCEPT BALTIC may, according to the amount of information voluntarily provided by the client, process the following personal data of the client: name, surname or username; gender; date of birth data (date, month and year of birth at the client’s choice); address; mobile phone number; e-mail.
 
3.4. For the registration of the client in the SALONCONCEPT BALTIC e-store, SALONCONCEPT BALTIC may, according to the amount of information provided by the client, process the following personal data of the client: name, surname or username; gender; date of birth data (date, month, year of birth); address; mobile phone number; e-mail, address.
 
3.5. For the performance of transactions carried out in the SALONCONCEPT BALTIC e-store – i.e. for the delivery of goods – SALONCONCEPT BALTIC may process the following personal data of the client depending on the delivery method chosen by the client: e-mail, name, surname; address; mobile phone number.
 
3.5. For sending SALONCONCEPT BALTIC news by e-mail, in SMS form or by post, SALONCONCEPT BALTIC may, according to the amount and purpose of the information provided by the client, process the following personal data of the client: e-mail, phone number, address.
 
3.6. For the purpose of protecting the property of SALONCONCEPT BALTIC, the following personal data of the client are processed: video image obtained from recordings of video cameras located in SALONCONCEPT BALTIC salons.
 
3.7. For the promotion of publicity of SALONCONCEPT BALTIC during publicity events organised by SALONCONCEPT BALTIC (presentations, store opening events, etc.) SALONCONCEPT BALTIC may process the following personal data of the client: photograph.


4. Purposes of personal data processing
 
4.1. SALONCONCEPT BALTIC processes the obtained personal data of clients solely in accordance with the purposes (objectives) listed below, complying with the requirements of the laws and regulations governing personal data processing and depending on the amount of personal data provided by the client and the consent given for specific processing purposes.
 
4.2. SALONCONCEPT BALTIC processes the obtained personal data of clients for the following specific purposes:
 
4.2.1. name, surname or username – for identifying the client in SALONCONCEPT BALTIC salons, providing the client with the possibility to use the client card without presenting it; as well as for the registration of the client in the SALONCONCEPT BALTIC e-store and for ensuring access to the SALONCONCEPT BALTIC e-store;
 
4.2.2. gender – for creating special SALONCONCEPT BALTIC offers that are more appropriate to the client’s gender;
 
4.2.3. date of birth data (date, month, year of birth) – for granting discounts on the client’s birthday;
 
4.2.4. address – for sending seasonal catalogues, informational materials and invitations by post to the client, as well as for the delivery of goods ordered in the SALONCONCEPT BALTIC e-store, if the delivery method chosen by the client requires an address in order to deliver the goods to the client;
 
4.2.5. mobile phone number – for sending SMS messages about current special promotional offers and invitations to events; and also, if the client has indicated a phone number when placing an order in the SALONCONCEPT BALTIC e-store – for communication regarding the delivery of goods ordered in the SALONCONCEPT BALTIC e-store;
 
4.2.6. e-mail – for sending SALONCONCEPT BALTIC news in electronic form; for providing the client with access to the SALONCONCEPT BALTIC e-store; for sending notifications necessary for the order placed in the SALONCONCEPT BALTIC e-store, for payment and for providing delivery information to the client, if the client places an order for goods in the SALONCONCEPT BALTIC e-store;
 
4.2.7. video image – for video surveillance in the premises of SALONCONCEPT BALTIC salons in order to protect the property of SALONCONCEPT BALTIC, prevent theft in SALONCONCEPT BALTIC salons, detect thefts committed in SALONCONCEPT BALTIC salons, identify persons who commit thefts, as well as to ensure the vital interests of individuals, including the protection of life and health;
 
4.2.8. photograph – for the promotion of publicity of SALONCONCEPT BALTIC during publicity events organised by it.
 
4.3. SALONCONCEPT BALTIC informs that part of the data processing purposes indicated in point 4.2 may be implemented in an automated manner, including by profiling the client, with the aim of providing new, special and individual SALONCONCEPT BALTIC offers to a particular client, taking into account the information obtained by SALONCONCEPT BALTIC and automatically compiled from the personal data provided by the client and from previous purchases in SALONCONCEPT BALTIC salons, if the client has given consent thereto.


5. Legal basis and period of personal data processing
 
5.1. The personal data processing carried out by SALONCONCEPT BALTIC may be performed only on the basis of one of the following legal grounds:
 
5.1.1. Client’s consent – the client’s personal, freely given, specific and informed indication that the client agrees to the processing of his or her personal data. For each type of personal data to be provided, SALONCONCEPT BALTIC has indicated one of the purposes mentioned in point 4.2 for which the client, at his or her discretion, may give SALONCONCEPT BALTIC consent to process his or her personal data. By personally providing his or her personal data, the client confirms his or her consent to their processing.
 
When sending invitations to publicity events organised by SALONCONCEPT BALTIC, at which photography is planned for the purpose of promoting publicity of SALONCONCEPT BALTIC, SALONCONCEPT BALTIC includes in the invitation a notice about photography at the event. By attending the event, the client expresses active, informed consent to the possible processing of his or her personal data – photographs.
 
5.1.2. Fulfilment of a legal obligation – if this arises from laws and regulations or administrative acts issued by state institutions or from lawful requests, SALONCONCEPT BALTIC is entitled to process the data received from the client to the extent necessary to comply with the relevant requirements of laws, regulations or administrative acts or to respond to official lawful requests of state institutions.
 
5.1.3. Legitimate interests – SALONCONCEPT BALTIC is entitled to process the personal data of clients in order to ensure its legitimate interests, in particular, but not limited to, the protection of property and security in SALONCONCEPT BALTIC salons and to ensure the vital interests of individuals, including the protection of life and health (video surveillance), and for the purposes of investigation or legal proceedings (reporting criminal offences committed in SALONCONCEPT BALTIC salons, bringing claims, defending against claims in courts, etc.).
 
In the case of video surveillance SALONCONCEPT BALTIC always clearly informs the client about the video surveillance carried out in the salon by placing a special sticker at the entrance to the salon. If the client does not wish to enter the video surveillance area, the client has the option to shop in the SIA “SALONCONCEPT BALTIC” e-store.
 
5.2. SALONCONCEPT BALTIC processes the personal data provided by clients for as long as the client’s consent to data processing remains in force, or as long as SALONCONCEPT BALTIC needs to protect its legitimate interests or to fulfil its legal obligations, and until the purpose of personal data processing has been achieved. Video surveillance material is stored for no more than four weeks. If the specific video surveillance material is necessary for the detection of theft, investigation, punishment of the person who committed theft or for the protection of the legitimate interests of SALONCONCEPT BALTIC, it is stored until these purposes are achieved.


6. Recipients of personal data
 
6.1. In processing the personal data of clients, SALONCONCEPT BALTIC observes strict confidentiality and ensures protection against unauthorised access by third parties to personal data, as well as against accidental loss or destruction of personal data. Where there is a lawful basis, SALONCONCEPT BALTIC may, as an exception, transfer the personal data of clients also to the following persons:
 
6.1.1. Data processors who, on behalf of SALONCONCEPT BALTIC and in accordance with the instructions of SALONCONCEPT BALTIC, process personal data, for example, service providers who on behalf of SALONCONCEPT BALTIC send SMS messages to clients about current special promotional offers;
 
6.1.2. state administrative institutions, law enforcement authorities, upon lawful request of such institutions;
 
6.1.3. persons who provide services to SALONCONCEPT BALTIC, for example, lawyers, if there is a lawful basis for the transfer of personal data to such service providers.


7. SALONCONCEPT BALTIC Cookie Policy
 
7.1. The SALONCONCEPT BALTIC website uses cookies that store information about the actions carried out by the website user on the website, such as the IP address used by the user, domain name, the web browser used and type of operating system, the duration of the website visit and the information searched on the website.
 
7.2. SALONCONCEPT BALTIC uses cookies only on the basis of explicit consent given by website users to their use. This condition does not apply to those cookies that are necessary for the proper functioning of the SALONCONCEPT BALTIC website but which do not store, for a long time, information about the actions carried out by the user on the SALONCONCEPT BALTIC website.


8. Client’s rights in relation to personal data processing carried out by SALONCONCEPT BALTIC
 
8.1. The client has the right to choose in what scope and which data to provide to SALONCONCEPT BALTIC, as well as to withdraw consent to the processing of his or her personal data in full or in part, requesting SALONCONCEPT BALTIC to terminate the processing of all or part of the client’s data. Withdrawal of consent does not affect the lawfulness of the processing of the client’s personal data carried out prior to the withdrawal.
 
8.2. If the client chooses not to provide personal data in any part or withdraws consent in full or in part (in respect of specific data provided), SALONCONCEPT BALTIC will not be able to provide the client with those services for which the respective personal data are necessary.
 
8.3. Taking into account that SALONCONCEPT BALTIC must clearly identify the client who fully or partially withdraws consent to personal data processing, the client may send the withdrawal to SALONCONCEPT BALTIC in the following ways:
 
8.3.1. If the client has been issued a client card – by sending the withdrawal to the SALONCONCEPT BALTIC e-mail address sales@salonconcept.lv from the e-mail address indicated by the client in the SALONCONCEPT BALTIC client form for receiving the client card, or the one indicated during registration in the SALONCONCEPT BALTIC e-store. In such a case, in the withdrawal e-mail the client must indicate name, surname or username (if the client has chosen one) and the client card number (if the client has been issued such a card), as well as the scope in which the consent is withdrawn.
 
8.3.2. By sending the withdrawal to the SALONCONCEPT BALTIC e-mail address sales@salonconcept.lv, signed with a secure electronic signature, indicating the client’s name, surname or username (if the client has chosen one) and the client card number (if the client has been issued a client card), as well as the scope in which the consent is withdrawn.
 
8.3.3. By sending the withdrawal by post to the legal address of SALONCONCEPT BALTIC: Krišjāņa Barona iela 64-4, Rīga, LV-1011, indicating the client’s name, surname or username (if the client has chosen one) and the client card number (if the client has been issued a client card), as well as the scope in which the consent is withdrawn.
 
8.4. The client has the right at any time to object to the processing of personal data carried out by SALONCONCEPT BALTIC, as well as to request that SALONCONCEPT BALTIC perform certain actions in relation to the client’s personal data by sending a request to SALONCONCEPT BALTIC in any of the ways indicated in points 8.3.1–8.3.3. The client has the right to request that SALONCONCEPT BALTIC:
 
8.4.1. issue the personal data held by SALONCONCEPT BALTIC concerning the client;
 
8.4.2. correct, delete or supplement personal data in accordance with the client’s instructions, substantiating his or her request;
 
8.4.3. restrict (temporarily suspend) the processing of a certain type or of all client data;
 
8.4.4. cease automated processing of client data (automated individual decision-making in relation to the client), including profiling;
 
8.4.5. transfer personal data to another controller – in such scope and form as the data are held by SALONCONCEPT BALTIC.
 
8.5. The client has the right to obtain from SALONCONCEPT BALTIC information on the fact of the transfer of personal data to third parties and on the persons (natural or legal) and/or state institutions to whom SALONCONCEPT BALTIC has provided any information related to the personal data of the particular client, except in cases where such information has been provided on the basis of a request by an operational activity entity or another competent authority within the framework of criminal proceedings, or in other cases where laws and regulations directly prohibit the disclosure of the relevant information.
 
8.6. In case of questions related to the personal data processing or protection carried out by SALONCONCEPT BALTIC, the client has the right to contact the personal data protection specialist of SALONCONCEPT BALTIC. Data protection specialist: Laura Kontante, sales@salonconcept.lv.
 
8.7. In the event of disagreements related to the personal data processing carried out by SALONCONCEPT BALTIC, the client has the right to lodge a complaint with the supervisory authority – the Data State Inspectorate (Datu valsts inspekcija).


9. Changes to the Privacy Policy
 
9.1. SALONCONCEPT BALTIC may make changes to the Privacy Policy at any time and at its own discretion, if such changes comply with the requirements of laws and regulations in the field of personal data protection. The amendments enter into force after their publication on the SALONCONCEPT BALTIC website. It is your responsibility to periodically reread this Privacy Policy to make sure that you are aware of the changes.
